Milwaukee County OWI 1st offense case dismissed: not guilty verdict

Our client was charged with OWI 1st Offense and PAC 1st Offense.  After a long night at work, she stopped at a local gas station to get a drink, and took a few minutes to rest in her car before heading home.  The employees at the gas station contacted police out of concern for her since her car had been parked at the gas station for a while.  The police arrived to question our client.

Our client told the officers of her activities that evening, including the fact that she had been present at the gas station for some time.  The officers believe she was under the influence of alcohol or drugs, and asked her to perform field sobriety tests.  Following those tests, the police ultimately arrested her for OWI.

Our attorney obtained all of the evidence in the case, including all of the police reports, squad video, and surveillance video from the gas station.  After thoroughly reviewing all of that evidence, the attorney noticed that the surveillance video showed our client inside the gas station over an hour before police arrived, but it did not show the vehicle arriving at the gas station.  There was no video of who was driving the car, or what time the car was last driven.

Armed with this information, our attorney contacted the prosecutor to discuss the issues with the case – specifically that the prosecutor would be unable to prove when, or even if, our client drove the vehicle that night.  The prosecutor did not agree with our attorney, and so the case proceeded to trial.

During trial, our attorney asked the officers what time our client had operated her vehicle that evening, and neither officer could provide a satisfactory answer.  The evidence of operation did not exist.

Based on the testimony of the officers, and the argument by our attorney, the Court found our client Not Guilty of the OWI and PAC offenses.  All of the charges from that case were dismissed!
